These Terms of Use (“Terms”) govern your access to and use of the Mom Mogul websites, emails, digital products, Mom Mogul Reset Scorecard, and Boundary Hold & Pushback Studio (collectively, the “Services”). The Services are provided by Mom Mogul, owned by Alesha Mackey (“Mom Mogul,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to purchase or use the paid Services. By using the Services, you represent that you meet this requirement.
2. What you receive
The Survival Mode Exit Kit is a digital product that currently includes a 30-page implementation playbook, exercises and planning materials, First 3 Moves support, and access to the browser-based Boundary Hold & Pushback Studio, as described on the applicable sales or checkout page.
Digital access instructions are provided after purchase. You are responsible for providing a valid email address and maintaining access to the email account and device needed to use the Services.
3. Personal-use license
Subject to these Terms and successful payment, Mom Mogul grants you a limited, non-exclusive, non-transferable license to use the purchased materials for your personal, non-commercial use.
You may not copy, reproduce, publish, distribute, sell, sublicense, share, upload, modify for resale, or create competing products from the playbook, Studio outputs, templates, prompts, branding, or other Mom Mogul materials without written permission.
4. Your submissions
You retain ownership of information you submit to the Scorecard or Studio. You grant Mom Mogul and its service providers permission to process that information as reasonably necessary to provide, secure, and improve the Services, consistent with the Privacy Policy.
Do not submit information that you do not have the right to share. Do not submit passwords, payment-card details, government identification numbers, or information about another person unless you have permission and it is necessary.
5. Educational use only
The Services provide general educational, reflective, and planning guidance. They are not therapy, mental-health treatment, medical care, legal advice, financial advice, safety planning, crisis support, or a substitute for a qualified professional. See the Educational Guidance Disclaimer.
6. AI companion limitations
The Boundary Hold & Pushback Studio may use automated or artificial-intelligence-assisted generation to create planning language and suggestions from your inputs. Outputs may be incomplete, inaccurate, unsuitable, or not appropriate for your circumstances. Review every output and use your own judgment. Do not rely on the Studio for emergency, medical, legal, financial, or safety decisions.
7. Payments and digital purchases
The price and payment terms appear at checkout. Payments may be processed by Stripe or another payment provider identified at checkout. By submitting payment, you authorize the applicable charge and agree to the payment provider’s terms.
All digital purchases are final except where a refund is required by applicable law or approved under our Digital Product Refund and Access Policy.
8. No guaranteed results
We do not promise or guarantee a particular personal, family, emotional, professional, financial, or other result. Your experience depends on your circumstances, decisions, participation, and many factors outside our control.
9. Prohibited conduct
You may not use the Services to:
- Violate any law or another person’s rights.
- Interfere with, probe, damage, or disrupt the Services.
- Circumvent access controls or share paid access.
- Upload malicious code or abusive, unlawful, or infringing material.
- Use the Services to provide professional advice to another person.
- Misrepresent your identity or relationship with Mom Mogul.
We may suspend or terminate access when reasonably necessary to protect the Services, users, or our rights.
10. Intellectual property
The Mom Mogul name, logo, design, text, playbook, Studio interface, templates, graphics, and other content are owned by Mom Mogul or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
11. Third-party services
The Services may depend on third-party services such as Ari, Stripe, Google Drive, hosting providers, email providers, analytics tools, and the Boundary Hold & Pushback Studio host. Third-party terms and outages may affect access. We are not responsible for third-party services outside our reasonable control.
12. Availability and changes
We may update, modify, suspend, or discontinue part of the Services. We will make reasonable efforts to preserve purchased access, but we do not guarantee uninterrupted availability or that every feature will remain unchanged.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
14. Limitation of liability
To the maximum extent permitted by law, Mom Mogul and its owner, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, opportunities, or goodwill, arising from or related to the Services. Where liability cannot be excluded, it will be limited to the amount you paid for the applicable digital product during the period allowed by law.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mom Mogul and its owner, contractors, and service providers from claims, losses, liabilities, and expenses arising from your misuse of the Services, violation of these Terms, or violation of another person’s rights.
16. Governing law and disputes
These Terms are governed by the laws of Illinois, United States, without regard to conflict-of-law rules. Any dispute will be resolved in the courts located in Winnebago County, Illinois, unless applicable law requires another forum or the parties agree to another resolution method.
17. Changes to these Terms
We may update these Terms by posting a revised version and new effective date. Your continued use of the Services after an update means you accept the updated Terms.
